Baltimore sues xAI

Baltimore became the first U.S. city to sue xAI, alleging the Grok chatbot was used to generate deepfake porn — a legal escalation that increases regulatory pressure on Musk’s AI operations. The suit is already being framed as a test case for liability and content moderation in emergent chatbots. (cnbc.com)

The mayor and City Council of Baltimore filed the complaint in Baltimore Circuit Court on March 24, naming X Corp., xAI (xAI Corp. and xAI LLC) and SpaceX as defendants. (usnews.com) The city’s filing cites a Center for Countering Digital Hate analysis that estimated Grok generated about 3,002,712 sexualized images between Dec. 29, 2025 and Jan. 8, 2026, extrapolating roughly 23,338 images that appeared to depict children from a 20,000-image sample. (counterhate.com) Baltimore alleges violations of its Consumer Protection Ordinance and accuses the companies of deceptive and unfair trade practices, and it is seeking a court injunction to force changes to Grok’s design plus civil penalties, restitution and other relief for affected residents. (usnews.com) The complaint includes a Grok-generated image that Elon Musk posted on Dec. 31, 2025 and cites Musk’s Jan. 2026 statement that he was “not aware of any naked underage images generated by Grok,” while noting xAI limited image editing for users on Jan. 9 and imposed additional restrictions on Jan. 14. (usnews.com) A separate federal class action, Jane Doe v. xAI (No. 5:26-cv-00772), was filed in the Northern District of California on Jan. 23, 2026 alleging Grok produced and disseminated millions of nonconsensual sexualized deepfakes; that case remains active on the federal docket. (courtlistener.com) Baltimore’s municipal suit arrives amid international regulatory scrutiny — investigators in multiple countries and regions have opened probes into Grok’s image generation — a fact cited repeatedly by legal observers as raising cross‑jurisdictional enforcement questions.
