New Mandatory NYC Trash Bin Rules Start

- New York City will require properties with one to nine residential units to use official NYC Bins for trash setout starting June 2026. - The Department of Sanitation says fines start at $50, rise to $100, then $200, and nearly 1 million bins are already in use. - DSNY lists bin rules, sales locations and upcoming virtual info sessions on its residential containerization and NYC Bin pages.

New York City property owners with one to nine residential units must switch to the official NYC Bin for trash setout starting in June 2026, according to the Department of Sanitation. The rule applies to single-family homes, two-family homes and buildings with up to nine apartments, as well as some special-use buildings that receive DSNY collection. Since November 12, 2024, those properties have already been required to put trash in bins no larger than 55 gallons with secure lids. June is the next step: after that point, a generic lidded bin will no longer satisfy the trash rule for those buildings. ### Who has to change bins in June? Properties with one to nine residential units are the main group covered by the June 2026 requirement, DSNY says. The agency’s FAQ also says city agencies, nonprofits, houses of worship and professional offices in residential buildings that receive DSNY collection are required to use NYC Bins. Property owners and building managers are responsible for buying enough bins to hold the building’s trash. (nyc.gov) The existing rule remains in place until June: trash must be in a bin that is 55 gallons or less and has a secure lid. DSNY says owners who already use that kind of bin may keep using it until June, then must switch to the official city bin for trash setout. ### What exactly counts as the required bin? The NYC Bin is the city’s official trash container for these properties, according to DSNY and NYC311. (nyc.gov) The city says the bins carry the Department of Sanitation logo and include space for owners to mark the address. DSNY says official bins are also sold for recycling and composting, but only the trash bin is required. A March 4 DSNY announcement said all nine sizes and colors of official NYC Bins were available at New York City-area Home Depot stores, with in-store pickup through Home Depot and delivery through Instacart, DoorDash and Uber Eats. The agency said the 45-gallon bin is recommended for buildings with multiple units, the 35-gallon bin for smaller buildings or single-family homes, and a 25-gallon trash bin is available for properties with tighter space or less waste. (nyc.gov) ### What happens if an owner does not comply? DSNY says fines for setout violations involving these residential properties start at $50 for a first offense, rise to $100 for a second offense and reach $200 for a third and subsequent offense. The agency’s collection rules say fines can be issued for each violation and can increase with additional violations within a 12-month period. (nyc.gov) The sanitation department also says owners can be fined if trash is not fully contained, if lids cannot close securely, if bins are broken, or if waste spills out. For now, those penalties already apply to the city’s broader bin-and-lid requirement for small residential properties. Starting in June 2026, using the wrong bin for trash setout becomes part of that enforcement framework. That last point is an inference from DSNY’s published requirement and penalty pages. (nyc.gov) ### Where can owners buy the bins? Home Depot is the main pickup outlet named by DSNY. The city says official trash bins are available at all New York City Home Depot stores, while some optional recycling and compost bins are stocked only at select stores. Delivery is also available through Home Depot’s on-demand partners, including DoorDash, Instacart and Uber Eats. (nyc.gov) The Department of Finance also has a trash bin reimbursement program, according to DSNY’s FAQ and NYC311, though those pages direct owners elsewhere for eligibility and application details. ### Why is the city pushing containerization now? March 4 was the date DSNY said trash containerization had produced 15 straight months of declining rat sightings, based on 311 reports compared with the same month a year earlier. (nyc.gov) The agency also said New Yorkers had already ordered roughly 1 million NYC Bins since the containers were unveiled in July 2024. Mayor Eric Adams said in a 2024 DSNY release that the city was trying to get trash bags off sidewalks and cover more waste with bin rules. ### What should owners watch next? DSNY’s residential containerization page lists virtual info sessions on May 28, June 11 and June 25, all scheduled for 6 p.m. The agency’s website and NYC311 pages also direct owners to the official bin pages for purchasing details, rule updates and reimbursement information as the June 2026 compliance date arrives.
