Shareholder Lawsuit Deadlines Approach

Investors in several publicly traded companies are facing upcoming deadlines to join class-action lawsuits. Firms under scrutiny include Aquestive Therapeutics (AQST), Hub Group (HUBG), and agilon health (AGL), with deadlines looming in early March. The wave of litigation reflects increased investor scrutiny over corporate disclosures and alleged securities fraud.

The lawsuit against agilon health centers on allegations that the company made misleading statements and failed to disclose that it couldn't accurately track or forecast medical costs due to significant data and analytics gaps. This led to the company allegedly overstating the positive impact of its "strategic actions." The class period for this lawsuit covers investors who purchased securities between February 26, 2025, and August 4, 2025. On August 4, 2025, agilon announced the departure of its President and CEO, Steven Sell, which was classified as a termination without "cause." On the same day, the company released disappointing second-quarter financial results and suspended its 2025 guidance. This news caused agilon's stock price to plummet over 50%, closing at $0.88 per share on August 5, 2025. Hub Group is under investigation for potentially misrepresenting its purchased transportation costs and accounts payable for the first three quarters of 2025. On February 5, 2026, the company announced a delay in its full 2025 financial results and the need to restate its financials for the first three quarters of that year. Following this announcement, Hub Group's stock dropped by over 24% on February 6, 2026. Aquestive Therapeutics is being investigated for alleged securities fraud after the FDA identified deficiencies in its New Drug Application (NDA) for Anaphylm, a treatment for allergic reactions. The company's President and CEO announced on January 9, 2026, that these deficiencies would prevent discussions on labeling and post-marketing commitments. This news led to a 37.04% drop in Aquestive's stock price on the same day, closing at $3.91 per share.
