The Act mandates that businesses must obtain explicit and informed consent from users before processing their personal data for marketing, rendering purchased lists and implied consent as non-compliant. For businesses on the WhatsApp Business API, this means a fundamental shift from mass broadcasting to consent-driven, conversational commerce. The cost of doing business is also changing, as Meta has increased the price for marketing messages in India by approximately 10% effective January 1, 2026. This price hike specifically targets promotional messages, while utility and authentication messages remain at their previous rates. The new user controls directly impact a business's quality rating and sender reputation with Meta. A high block rate, which some sources suggest can be as low as 2-5%, can lead to messaging restrictions or even a permanent ban on a business's WhatsApp account. This makes it critical to monitor user feedback and ensure that promotional content is relevant and valuable to the recipient. To navigate this new landscape, businesses must implement clear opt-in mechanisms, such as checkboxes at checkout or QR codes, that explicitly state the purpose of collecting a user's phone number. It is also crucial to provide a simple and immediate way for users to opt-out of promotional messages, a requirement that is also being enforced by the Telecom Regulatory Authority of India (TRAI).
