OSHA Amends Rules for Electronic Disclosure Safe Harbors

New guidance in the Federal Register addresses technical amendments to OSHA's electronic disclosure safe harbors. - A recent OSHA final rule, effective January 1, 2024, expanded electronic reporting obligations for certain employers in high-hazard industries, including manufacturing. - Establishments with 100 or more employees in these designated industries are now required to electronically submit data from their Form 300 (Log of Work-Related Injuries and Illnesses) and Form 301 (Injury and Illness Incident Report) annually. - This is an expansion of the previous rule, which primarily required the electronic submission of only the Form 300A (Summary of Work-Related Injuries and Illnesses). - The annual deadline for submitting this data to OSHA via the Injury Tracking Application (ITA) is March 2. - OSHA intends to make this data publicly available, after removing personally identifiable information, to allow for broader analysis of workplace safety trends by the public and researchers. - The agency will use the more detailed data to better target its inspections and enforcement actions on establishments with higher injury and illness rates, increasing the compliance risk for manufacturers with poor safety records. - This heightened transparency creates potential reputational risks, as clients, investors, and potential employees will have greater visibility into a company's safety performance. - All employers, including those in manufacturing, are required to keep these injury and illness records on file for a minimum of five years.
