SCOTUS Could Hold Carriers Accountable
The Supreme Court may rule on whether carriers hiring unauthorized immigrant drivers are liable for damages in major crashes.
The case, *Delia Yaneth Nunez v. Pilgrim's Pride*, centers on a 2016 crash in Nebraska involving an undocumented immigrant driving for a trucking company contracted by Pilgrim’s Pride. Nunez, severely injured in the collision, sued Pilgrim's Pride, arguing the company was negligent in hiring practices that led to the accident. The 8th Circuit Court initially sided with Pilgrim's Pride, but the Supreme Court revived the case, focusing on whether federal law preempts state-level negligence claims related to hiring unauthorized workers. Oral arguments occurred on Feb. 24, 2026. A ruling against Pilgrim's Pride could incentivize companies to more thoroughly vet drivers' legal status, potentially reducing accidents caused by inadequately vetted or unqualified drivers. This could impact hiring practices across the trucking industry, especially for companies relying on subcontractors.
