Attorney on Proactive Accessibility Remediation

On the “Accessibility Frontlines” podcast, civil rights attorney Lila Grant stated, “We’re seeing a ramp-up in both voluntary compliance and preemptive litigation settlements. Colleges that demonstrate proactive remediation—especially for learning management systems—are in a much better position heading into April 2026.”

- The April 2026 deadline stems from a Department of Justice final rule revising Title II of the Americans with Disabilities Act (ADA), which now mandates specific web and mobile app accessibility standards for state and local government entities, including public colleges and universities. - Public institutions serving populations of 50,000 or more must comply by April 24, 2026, while those in areas with smaller populations have until April 26, 2027. - The mandated technical standard for accessibility is the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. This standard addresses barriers for individuals with disabilities, including those related to vision, hearing, and manual dexterity. - These regulations apply to all digital content, including websites, mobile applications, online learning platforms, and course materials such as syllabi and videos. - Some exceptions to the rule include archived web content, pre-existing social media posts, and certain individualized, password-protected documents. - Higher education institutions are a frequent target of digital accessibility lawsuits, with common complaints citing a lack of alternative text for images, no captions for videos, and poor keyboard navigation. - Serial plaintiffs have filed numerous website accessibility lawsuits against colleges and universities, alleging that inaccessible websites deny visually impaired individuals equal access to the institution's services. - In addition to private lawsuits, the Department of Justice can enforce compliance through investigations, settlement agreements, and lawsuits in federal court.
