Arizona Proposes Renter AC Standards

Lawmakers in Arizona are proposing statewide standards for air conditioning in rental units. The proposed legislation aims to provide protections for tenants facing extreme heat or heating failures. This move reflects a growing focus on climate resilience, building codes, and tenant rights, particularly for property owners and those with rental ADUs.

- The proposed legislation is Senate Bill 1608, introduced by State Senator Lauren Kuby with the support of Attorney General Kris Mayes. - The bill would mandate that the indoor temperature of a rental unit cannot exceed 82 degrees Fahrenheit. It also includes a standard for heating, requiring indoor temperatures to be at or above 68 degrees Fahrenheit during cold periods. - This proposal aims to create a uniform standard across Arizona, expanding on local ordinances already in place in cities like Phoenix and Tucson which set maximum cooling temperatures for rentals. - A key provision of the bill would reduce the time landlords have to fix a cooling issue to two days before a tenant can break their lease. Current law allows for a longer, less specific timeframe. - The legislation also seeks to prevent evictions during any week where the outdoor temperature reaches 90 degrees or higher on at least two days. - This legislative push follows a summer where the Attorney General's office intervened in multiple cases of prolonged AC outages in apartment complexes, including one incident in Phoenix where a resident died and another was hospitalized. - Statistics from Maricopa County highlight the urgency, showing that in 2024, about a quarter of heat-related deaths occurred indoors, and in 70% of those cases, the air conditioning was not working. - In response to the proposal, the Arizona Multi-Housing Association has stated that property owners already have clear legal guidelines and that they are committed to working with lawmakers on policies that balance the needs of both renters and owners.
