Moderna Settles LNP Patent Suit for $2.25B
Genevant Sciences and Arbutus Biopharma have entered into a $2.25 billion global settlement with Moderna. The deal resolves a major patent dispute over the lipid nanoparticle (LNP) delivery technology that was crucial for developing mRNA vaccines.
At the heart of the dispute is the lipid nanoparticle (LNP) delivery system, a microscopic fatty bubble that protects the delicate mRNA and transports it into human cells. Without this LNP shield, the mRNA in the vaccine would be quickly destroyed by the body and rendered ineffective. Arbutus Biopharma, a small Canadian firm, had been developing and patenting this LNP technology for nearly two decades. Their work led to the first-ever FDA-approved RNA-LNP therapeutic, a drug called Onpattro, which was approved in 2018. Moderna was aware of Arbutus's patents and had previously licensed the LNP technology for other research projects. However, for its COVID-19 vaccine, Moderna used the technology without a license, prompting the lawsuit from Arbutus and its licensee, Genevant Sciences. The settlement includes a $950 million upfront payment to Genevant and Arbutus, with a potential additional $1.3 billion depending on the outcome of an appeal concerning government liability. If the full amount is paid, it would represent the largest disclosed patent settlement in the history of the pharmaceutical industry.
