Minnesota city registers hemp edible retailer

The Alexandria City Council in Minnesota has officially registered a local business to sell lower-potency, hemp-derived edibles. The action formalizes the retailer's compliance with state regulations regarding product safety, labeling, and age restrictions for such products.

Minnesota's legal framework for hemp-derived edibles was established on July 1, 2022, allowing the sale of products containing up to 5 milligrams of THC per serving and 50 milligrams per package. This state-level legislation paved the way for local municipalities like Alexandria to register and regulate retailers. The regulations are specific: products cannot be marketed to children, must be sold to individuals 21 or older, and require child-resistant, tamper-evident, and opaque packaging. These rules aim to ensure consumer safety and prevent accidental ingestion. Regulatory oversight has been a key focus. Initially under the Board of Pharmacy, authority is transitioning to the new Office of Cannabis Management, which will handle statewide licensing. However, all licensed retailers must also register with their local city or county, a requirement Alexandria's recent action fulfills. The move to regulate these products followed a period where delta-8-THC items were being sold without clear oversight. This led to enforcement actions, including a notable 2022 lawsuit by the Board of Pharmacy against a company for selling products that far exceeded the legal THC limits and were designed to appeal to children. The hemp industry has shown significant economic potential for Minnesota, with an estimated 721,576 adults consuming cannabis monthly and potential annual sales reaching over $1.3 billion. In 2024, hemp-derived cannabis products generated more than $11.5 million in state sales tax revenue. However, the future of this industry faces uncertainty. A federal ban on intoxicating hemp-derived products is set to take effect in November 2026, which could devastate Minnesota's carefully regulated market and threaten thousands of jobs across farms, breweries, and retail stores.
