Maharashtra Mandates Digital Shop Act Registration

The state of Maharashtra has made Shop Act registration under the Shop and Establishment Act mandatory and fully digitized for all new businesses. This regulation applies to all sellers, including those operating at pop-up events and handicraft vendors. The move aims to formalize small businesses while providing a streamlined online application process.

- The legal framework for this mandate is the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act of 2017, which replaced the earlier 1948 Act to digitize processes and strengthen employee protections. This registration, locally known as the Gumasta License, is a prerequisite for opening a business bank account and is often required to apply for other licenses like GST registration. - The registration requirements differ based on the number of employees. Businesses with 10 or more workers must obtain a formal registration certificate, while those with fewer than 10 employees are only required to provide an online intimation of their business commencement. - The digital certificate serves as legal proof of the business's existence, which enhances credibility with customers and partners. This legal recognition is also beneficial for securing business loans, as financial institutions often require it as part of the loan application process. - Failure to register can lead to significant penalties, including fines that can be up to ₹1,00,000, with additional daily fines for ongoing non-compliance. In serious cases of violation, it could even lead to the cancellation of a business license. - The Act regulates crucial employment conditions, including work hours, overtime pay, rest intervals, and leave policies, aiming to protect employee rights. For instance, it mandates that employees working beyond nine hours a day or 48 hours a week are entitled to overtime pay. - The 2017 Act introduced provisions to prevent discrimination against women in recruitment, promotion, and wages and allows them to work night shifts with their consent, provided the employer ensures their safety and transportation. - For establishments with 50 or more workers, the Act mandates the provision of a crèche facility, and for those with 100 or more employees, a canteen facility is required. - The entire registration process is now handled online through the official government portal, where business owners can fill out the application, upload necessary documents like identity proof and proof of business address, and pay the fees.
