Death Penalty Sought in Fremont Case

The case against Luigi Mangione is federal, not local to Fremont, stemming from the December 4, 2024, shooting death of UnitedHealthcare CEO Brian Thompson in Manhattan. Following a five-day manhunt, Mangione was arrested at a McDonald's in Altoona, Pennsylvania. In a significant move on April 1, 2025, U.S. Attorney General Pam Bondi directed federal prosecutors to seek the death penalty, labeling the killing a "premeditated, coldblooded assassination." This marked the first time Bondi's Justice Department had sought capital punishment and aligned with a push to resume federal executions. The federal charges against Mangione included interstate stalking resulting in death and, crucially, murder through the use of a firearm, which legally opened the door for a potential death sentence. This was necessary for federal jurisdiction because New York, where the murder occurred, abolished its state death penalty in 2007. However, in a major reversal on January 30, 2026, a federal judge dismissed the death-eligible firearm charge, ruling it was "legally incompatible" with the stalking charges. This decision, described as a significant blow to the administration's death penalty revival efforts, means Mangione no longer faces capital punishment. Mangione's defense team had challenged the capital charge by arguing that Attorney General Bondi had a "profound conflict of interest." Her former lobbying firm, Ballard Partners, counts UnitedHealth Group, the parent company of the victim's organization, as a client. During his arrest, police found a backpack containing a 9mm handgun, which prosecutors say matches the murder weapon, and a notebook detailing disdain for the health insurance industry. Mangione has pleaded not guilty to both state and the remaining federal charges.
