TPS updates: I-9 & E-Verify
Recent TPS updates for Haiti and Syria include new I‑9 and E‑Verify guidance issued this week — employers and HR teams should note changed verification procedures for these beneficiaries (x.com).
USCIS’s Form I‑9 Central update for Haiti (published March 25, 2026) directs employers to enter “as per court order” in Section 1, record “July 1, 2026” in Section 2, and add a note in the additional information box when completing Form I‑9. (uscis.gov)) USCIS’s Form I‑9 Central update for Syria (published March 24, 2026) likewise instructs employers to enter “as per court order” in Section 1, enter “July 1, 2026” in Section 2, and notes that certain Syria EADs are extended pursuant to Dahlia Doe v. Noem, No. 25‑cv‑8686 (S.D.N.Y.). (uscis.gov)) Department of Homeland Security’s E‑Verify pages issued earlier guidance that differed by date — E‑Verify told employers on March 13, 2026 to use “March 27, 2026” for Haiti cases and on March 12, 2026 to use “March 13, 2026” for Syria cases — guidance the later USCIS notices supersede. (e-verify.gov)) USCIS’s Haiti alert lists the specific original EAD expiration dates extended by the D.D.C. stay, including February 3, 2026 and earlier EADs with original expirations of August 3, 2025; August 3, 2024; June 30, 2024; February 3, 2023; December 31, 2022; October 4, 2021; January 4, 2021; January 2, 2020; July 22, 2019; January 22, 2018; and July 22, 2017. (uscis.gov)) USCIS’s Syria alert specifies the EAD original expiration dates extended by the S.D.N.Y. stay as September 30, 2025; March 31, 2024; September 30, 2022; and March 31, 2021. (uscis.gov)) Both USCIS updates instruct employers to download and attach the relevant Alert and TPS country webpages to Form I‑9, and to use the July 1, 2026 expiration date from the I‑9 when completing or updating E‑Verify cases; the USCIS pages were last reviewed/updated March 24–25, 2026.
