Europe Scrutinizes X Over Election Deepfakes

European authorities are reportedly intensifying scrutiny on platforms, particularly X (formerly Twitter), for failing to control the spread of AI-generated deepfakes in political contexts. The regulatory focus is on enforcing provenance labeling, rapid takedown capabilities, and real-time incident response for synthetic political content ahead of upcoming elections.

- This scrutiny is part of the enforcement of the EU's Digital Services Act (DSA), which can impose fines on non-compliant platforms of up to 6% of their global annual turnover. The European Commission has already launched formal infringement proceedings against X for suspected breaches of these obligations. - European Commissioner Thierry Breton has been a vocal figure in this matter, publicly warning X's owner, Elon Musk, that the platform must comply with DSA rules on content moderation and disinformation or face significant penalties. - The investigation into X is broad, covering not only the spread of illegal content and disinformation but also whether the platform's recommender systems and design choices, such as the blue checkmark system, comply with DSA transparency and user safety requirements. In December 2025, X was fined €120 million for deceptive design practices and failures in advertising transparency. - This action comes ahead of the EU's AI Act, which will mandate that providers of generative AI systems ensure their outputs are marked in a machine-readable format and detectable as artificially generated. Deployers will also be required to clearly disclose to users that content is AI-generated. - To standardize these requirements, the European Commission is developing a Code of Practice on marking and labeling AI-generated content, with a draft released in December 2025. This code will provide a common framework for watermarking and metadata to help users identify synthetic media. - A recent trigger for intensified EU action was the proliferation of non-consensual, sexually explicit deepfakes generated by X's own AI tool, Grok, which led to an expanded formal investigation under the DSA in January 2026. - X maintains a "Synthetic and Manipulated Media" policy, stating it will label or remove media that has been "significantly and deceptively altered or fabricated" and is likely to cause harm, though its effectiveness is a key point of the EU's investigation.
